Privacy Policy

This Privacy Policy describes how Cush Network, operated by Team Cush Real Estate / Pinnacle Plus Realty Limited ("we," "us," or "our"), collects, uses, and protects personal information on cushnetwork.com. We comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) and Canada's Anti-Spam Legislation (CASL).

1. Who We Are

Cush Network is a free online directory operated by Team Cush Real Estate, a registered brokerage under the Trust in Real Estate Services Act, 2002 (TRESA) in Ontario. Our principal broker is Zac Cushing.

2. Information We Collect

From buyers and sellers (site visitors):

• First and last name
• Email address
• Phone number
• Whether you are buying, selling, or both
• Any notes or messages you include in your contact request

From real estate professionals who join the directory:

• Full name, email, and phone number
• Company / brokerage name
• License or registration number (RECO, FSRA, or other regulator)
• Professional bio, photo, video link, regions served, and specialities
• Electronic signature on the referral agreement
• IP address region at time of signing (Ontario, Canada)

Automatically collected:

• Browser type and device type (through standard server logs)
• Pages visited and time of visit
• We do not use advertising trackers or third-party analytics pixels

3. How We Use Your Information

We use the information we collect to:

• Connect buyers and sellers with professionals they have requested to contact
• Notify professionals of new client inquiries
• Maintain our internal CRM for transaction management and follow-up
• Fulfil our obligations under the referral agreement (track closed transactions)
• Respond to inquiries sent to us directly
• Send professionals communications about their listing, platform updates, and referrals (only where CASL consent has been given)
• Comply with TRESA, RECO, FSRA, and other applicable regulatory obligations

We do not use your personal information for targeted advertising. We do not sell, rent, or trade personal information to any third party.

4. Referral Fee Disclosure

Pursuant to section 18(4) of the RECO Code of Ethics under TRESA: when a transaction closes with a professional found through the Cush Network directory, a referral fee may be payable to Team Cush Real Estate / Pinnacle Plus Realty Limited by the professional — not by the buyer or seller. This fee is agreed to in writing by professionals when they join the directory. There is no cost to buyers or sellers to use this platform.

5. Sharing of Information

We share your personal information only in the following circumstances:

• With the professional you contact: your name, phone, email, and note are shared with the professional you select so they can reach out to you.
• With our technology providers: we use Supabase (database, hosted in the US) and Netlify (form processing and hosting) to operate the platform. These providers are bound by their own privacy policies and data processing agreements.
• As required by law: we may disclose information if required by a court order, regulator (including RECO or FSRA), or other legal obligation.

6. Data Retention

We retain personal information for as long as necessary to fulfil the purposes described in this policy and to comply with our legal obligations. For transaction records, we follow RECO's minimum 6-year retention requirement. For general contact records, we retain information for up to 3 years from last contact, after which it is deleted.

7. Your Rights (PIPEDA)

Under PIPEDA, you have the right to:

• Access the personal information we hold about you
• Correct any inaccurate information
• Withdraw consent for communications at any time (see Section 8)
• Request deletion of your information (subject to legal retention requirements)

To exercise any of these rights, email us at zac@teamcush.ca with the subject line "Privacy Request." We will respond within 30 days.

8. CASL — Withdrawing Consent for Communications

If you are a professional listed on Cush Network and wish to stop receiving communications from us, you can unsubscribe at any time by emailing zac@teamcush.ca with the subject "Unsubscribe." We will process your request within 10 business days. Note that withdrawing consent for communications does not affect your referral agreement obligations on any transactions already in progress.

9. Security

Personal information is stored in a secured database (Supabase) with access controls, row-level security policies, and encrypted connections. Profile photos are stored as encrypted data. We limit access to personal data to only those employees and contractors who need it to operate the platform.

No method of transmission over the internet is 100% secure. While we take reasonable precautions, we cannot guarantee absolute security.

10. Cookies

Cush Network uses browser localStorage to save your checklist progress and session preferences. No advertising cookies or third-party tracking cookies are used. Our hosting provider (Netlify) may set essential operational cookies; see Netlify's privacy policy for details.

11. Children's Privacy

Cush Network is not directed at children under 18. We do not knowingly collect personal information from minors.

12. Changes to This Policy

We may update this Privacy Policy from time to time. The "Last updated" date at the top of this page indicates when the most recent changes were made. Continued use of the site after changes constitutes acceptance of the updated policy.
